Terms of Service

Wired to WIN™ serves student-athletes, many of whom are minors. If you are enrolling an athlete under 18, these Terms apply to you as the parent or legal guardian, and you accept them on your athlete's behalf. Enrolled families also sign a separate Program Agreement covering participation details.

1. Agreement to These Terms

Mind Body Athlete™ is operated by Mind Body Athlete LLC ("Mind Body Athlete," "MBA," "we," "us," or "our"), a limited liability company organized under the laws of the State of Wyoming. These Terms govern your use of mindbodyathlete.org, our programs including Wired to WIN™ Academy and Wired to WIN™ Elite, our assessments, digital materials, community spaces, coaching sessions, and any related service we provide (together, the "Services").

By using the Site or Services, you agree to these Terms. If you do not agree, please do not use them. Where these Terms and a signed Program Agreement differ, the Program Agreement controls for that enrollment.

2. Who May Enroll, and Guardian Consent

Purchasers must be 18 or older and have legal authority to enter a binding contract.

Athletes under 18 participate with guardian consent. The parent or legal guardian must complete the enrollment, accept these Terms, and consent to the athlete's participation. The guardian remains responsible for the athlete's conduct and for payment obligations.

By enrolling a minor athlete, you consent to Mind Body Athlete LLC working directly with your athlete in coaching sessions, and to us asking your athlete about their competitive experience, pressure, confidence, identity, goals, setbacks, and how these show up in school and daily life. This is the substance of the coaching. Full details of what participation involves are set out in the Program Agreement you sign at enrollment.

Athletes 18 and older may enroll on their own behalf.

You confirm that the information you provide is accurate and that you are the parent or legal guardian with authority to give this consent.

3. What the Services Are, and What They Are Not

Wired to WIN™ is mental performance training and coaching. It is not therapy, counseling, psychological treatment, medical care, or any form of clinical or crisis service.

We do not diagnose or treat any medical, psychiatric, or psychological condition. Nothing in the Services is medical or mental health advice, and nothing substitutes for care from a licensed professional.

If an athlete is currently in mental health treatment, we encourage you to discuss participation with that provider. If we believe an athlete would be better served by clinical support, we may recommend it, and we may pause or end participation where continuing is not appropriate.

In an emergency, or if you believe an athlete is at risk of harm, contact 911 or your local emergency service immediately. In the United States, the 988 Suicide and Crisis Lifeline is available by call or text. Do not use our community spaces, email, or session time to report an emergency.

4. No Guarantee of Athletic or Personal Results

Mental performance training is a skill-building process, and outcomes depend on the athlete's participation, practice, coachability, environment, and circumstances outside our control.

We make no promise or guarantee regarding competitive performance, playing time, statistics, team selection, recruitment, scholarship offers, roster spots, or any specific personal or academic outcome. Any examples or descriptions of results are for context only and are not a prediction of what any individual athlete will experience.

Your satisfaction protection is defined solely by the 30-Day Athlete Confidence Guarantee in our Refund Policy.

5. Program Access and Delivery

Each program's format, length, session structure, and included materials are described at purchase. Unless stated otherwise:

  • Live sessions are held virtually and scheduled by us based on cohort availability.
  • Sessions may be recorded and shared with enrolled participants of that cohort.
  • Access to materials and recordings is granted for the period stated at purchase.
  • We may adjust session dates, times, curriculum sequence, delivery method, or guest contributors where reasonably necessary, and will give notice where we can.
  • Missed sessions are not refunded, credited, or individually rescheduled. Recordings are provided so participants can catch up.

Participation is expected. We may remove a participant who is persistently absent or disengaged, without refund, though we will address it with you first.

6. Payment, Plans, and Billing

Prices are in U.S. Dollars and listed at checkout. Payment is processed by third-party providers, and we do not store your full payment card details.

If you choose an installment plan, you authorize automatic charges on the stated schedule until the balance is paid in full. Installment plans total more than paying in full. Enrolling on a plan is a commitment to the full program price, not a per-session arrangement, and remaining installments stay due unless a refund is approved under our Refund Policy.

If a payment fails, we may pause access until it is resolved. You are responsible for keeping your payment method current and for any taxes that apply in your location.

Billing questions. Contact [email protected] before filing a chargeback. Filing one without contacting us may result in loss of access while the dispute is reviewed.

7. Refunds

Refunds are governed by our Refund Policy, incorporated into these Terms.

8. Coaching Confidentiality With Your Athlete

Athletes do their best work when they can be honest. What your athlete shares with us in a coaching context is treated as confidential, and we do not report the content of those conversations back to you as a matter of routine. We will share progress, patterns, and how to support your athlete at home.

We will inform you, and where appropriate the relevant authorities, if we learn or reasonably believe that:

  • Your athlete is at risk of harming themselves
  • Your athlete may harm another person
  • Your athlete or another minor is experiencing abuse, neglect, or exploitation
  • There is a medical or safety emergency
  • Disclosure is required by law, subpoena, or court order

In these situations we act promptly and do not wait for permission.

Important limitation. This is a professional practice commitment, not a legal privilege. Mind Body Athlete LLC does not provide clinical or licensed mental health services, and communications with us are not protected by therapist, physician, or attorney privilege. We comply with applicable mandatory reporting laws regarding suspected child abuse or neglect.

Group sessions are not confidential in the way an individual conversation is. Anything shared in a group session or community space is heard by the other participants in that space, and while participants are bound by Section 11, we cannot guarantee how others will treat what they hear.

9. Recording, Privacy, and Testimonials

Recording. Live sessions may be recorded for participant access and internal quality review. By participating, you consent to the athlete appearing in those recordings, which are shared only with enrolled participants of that cohort.

Participants may not record, screenshot, download, or share any session, chat, or community post.

Anonymized use. We may use athlete progress, feedback, and coaching outcomes in anonymized and de-identified form for marketing, teaching, and program improvement. Anonymized means no name, photograph, video, audio, school, team, or jersey number, and no combination of details that would reasonably identify your athlete. Your Program Agreement includes an option to opt out of this entirely, and opting out has no effect on your athlete's participation or support. You may also opt out at any time later by emailing [email protected].

Named testimonials are separate and always optional. Parents and guardians are welcome to give their own named testimonial, and adult athletes may give their own. We will never use a minor athlete's name, image, likeness, voice, or attributed quote without separate written guardian permission given specifically for that purpose.

10. Community Conduct

Athlete spaces and adult spaces are kept separate. Athletes participate in athlete channels and sessions. Parents and guardians participate in their own channels and sessions. Adults do not participate in athlete spaces, and athletes do not participate in adult spaces. Attempting to access, post in, or contact participants in a space you are not assigned to is prohibited.

Within every space, participants and guardians agree not to:

  • Harass, bully, demean, or threaten any participant, guardian, or member of our team
  • Post profane, sexual, discriminatory, or otherwise inappropriate content
  • Share another family's private information outside the community
  • Solicit, advertise, or recruit for other programs, teams, or services
  • Give medical, psychological, or clinical advice to other participants

Communications that take place outside our official program channels are outside our supervision and outside the scope of the Services, and we are not responsible for them. If we become aware of prohibited conduct, we will act, including removing the person involved, notifying affected guardians, and reporting to authorities where required or warranted.

We may remove content, restrict access, or end participation for violations of this section, immediately and without refund where the conduct is serious.

11. Confidentiality, Non-Disclosure, and Intellectual Property

All materials, frameworks, systems, and content provided through the Services are and remain the exclusive property of Mind Body Athlete LLC. This includes Mind Body Athlete™, Wired to WIN™, the WIN Framework™, the Athlete Wiring system and its archetypes, assessments and scoring logic, curriculum, session content, worksheets, playbook templates, trackers, scripts, audio tools, recordings, logos, and branding. Nothing in these Terms transfers ownership to you.

On enrollment we grant you a limited, personal, non-transferable, revocable license to use these materials for the enrolled athlete's own development.

You and your athlete agree to keep confidential all non-public information received through the Services, including the above materials and anything shared by another participant, athlete, or guardian in a session or community space. You agree not to disclose, publish, post, distribute, teach, resell, or share it outside the program, and not to use it to create or support a competing program, workshop, curriculum, or coaching service.

This obligation continues after your enrollment ends. It does not apply to information already public through no fault of yours, or that you are legally compelled to disclose. Because a breach could cause harm that money alone cannot fix, we may seek injunctive relief in addition to any other remedy.

12. Content You and Your Athlete Submit

Reflections, assessments, worksheets, posts, and questions submitted by you or your athlete remain yours. You grant us permission to use that content to deliver and improve the Services, and in anonymized form as described in Section 9. We will not publish or attribute submitted content by name without separate written permission, and never for content submitted by a minor without guardian permission.

13. Communications

By providing your contact information you agree that we may contact you by email about enrollment, scheduling, and program logistics. If you opt in to text messages, message and data rates may apply, and you can stop by replying STOP. Marketing emails include an unsubscribe link. Transactional messages about an active enrollment may continue after you unsubscribe from marketing.

14. Assumption of Risk

Mental performance work can surface difficult feelings connected to competition, identity, injury, or family expectations. That is a normal part of the process, but you accept that participation carries that possibility.

Any physical practices introduced, such as breathing techniques or grounding movement, are voluntary. Participants should stop anything that causes discomfort and should consult a physician before participating if there is any relevant medical condition.

15. Disclaimer of Warranties

The Services are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error free, or that they will produce any particular result. Some jurisdictions do not allow certain exclusions, so parts of this section may not apply to you.

16. Limitation of Liability

To the fullest extent permitted by law, Mind Body Athlete LLC and its owners, contractors, and affiliates will not be liable for indirect, incidental, consequential, special, or punitive damages, including lost opportunities, lost recruitment or scholarship prospects, competitive outcomes, or emotional distress, arising from your use of the Services.

Our total liability for any claim relating to these Terms or the Services will not exceed the amount you paid us in the twelve months before the claim arose. Some jurisdictions do not allow these limitations, so parts of this section may not apply to you.

17. Indemnification

You agree to indemnify and hold harmless Mind Body Athlete LLC, its owners, contractors, and affiliates from claims, damages, losses, and reasonable legal costs arising from your use of the Services, your athlete's participation, your violation of these Terms, or your violation of any law or third-party right.

18. Third-Party Platforms

We deliver the Services using third-party platforms for video, payments, scheduling, email, and community. We do not control those platforms and are not responsible for their availability, terms, or handling of your data. Your use of them is subject to their own terms.

19. Suspension and Termination

You may stop participating at any time. Stopping does not entitle you to a refund except as set out in the Refund Policy.

We may suspend or end access where these Terms are violated, where payment fails, where conduct harms other participants, or where we believe continued participation is not appropriate for the athlete. Where we end access for a reason other than a violation by you, we will refund the unused portion on a fair basis.

Sections 8, 11, 16, 17, and 20 survive termination.

20. Disputes and Governing Law

Talk to us first. Before starting any formal proceeding, contact [email protected] so we can try to resolve it directly.

These Terms are governed by the laws of the State of Wyoming, without regard to its conflict of law rules. Any dispute that cannot be resolved informally will be brought in the state or federal courts located in Sheridan County, Wyoming, and you consent to that jurisdiction and venue.

21. General

If any provision is found unenforceable, the rest stays in effect. Our not enforcing a provision at one time does not waive our right to enforce it later. You may not transfer your rights under these Terms without our written consent. These Terms, together with our Refund Policy and your signed Program Agreement, form the entire agreement between us regarding the Services.
